Part C Developmental Delay Eligibility Criteria
40% delay in functional abilities/ developmental skills in one or more areas of development; or 25% delay in functional abilities/ developmental skills in two or more areas of development; or substantially atypical development in two or more developmental areas, even when evaluation does not document a 25% delay
At-Risk Served Under Federal Part C Policies
Eligibility under the at-risk category: 5 or more risk categories, that when present in combination, are likely to result in substantial developmental delay if early intervention services are not provided. At-risk factors include:
- LBW (1500 g or less, considered up to 24 months of age)
- SGA (less than 10th percentile)
- GA (32 weeks or less, considered up to 24 months of age)
Biological risk factors that can be considered under the at-risk categories include:
- Perinatal factors (including Failure to Thrive and Maternal Factors [PKU, Teratogen Exposure])
- Toxic Exposure (including Maternal Phenylketonuria (PKU) and Maternal Substance Abuse)

List of recognized established conditions includes the following severe sensory impairment conditions:
- Bilateral external ear anomalies
- Hearing impairment
Vision Impairment
List of recognized established conditions includes the following severe sensory impairment conditions:
- Optic nerve atrophy
- Blindness
- Lebers Ameurosis
- Optic nerve hypoplasia
- Retinoblastoma
- Vision impairment
Prenatal Exposure to Substances
State policy does not go beyond federal regulatory language.
Prematurity
Not included on state list of diagnosed/established conditions.
Low Birth Weight, Very Low Birth Weight, Small for Gestational Age
Not included on state list of diagnosed/established conditions.
Prenatal Exposure to Zika
