Part C Developmental Delay Eligibility Criteria
Delay of at least 25% in one or more of areas of development; or a delay of at least 33% if the child's only delay is in expressive language; or a qualitative determination of delay, as indicated by responses or patterns that are disordered or qualitatively different from what is expected for the child's age, and significantly interfere with the child's ability to function in the environment

One of the three eligiblity categories is auditory or visual impairment as defined by the Texas Education Agency rule at 19 TAC § 89.1040 (relating to Eligibility Criteria).
Vision Impairment
One of the three eligibility categories is auditory or visual impairment as defined by the Texas Education Agency rule at 19 TAC § 89.1040 (relating to Eligibility Criteria).
Prenatal Exposure to Substances
Medically diagnosed conditions that have a high probability of resulting in developmental delay include:
- Newborn (suspected to be) affected by noxious substances transmitted via placenta or breast milk
- Neonatal withdrawal symptoms from maternal use of drugs of addiction
- Withdrawal symptoms from therapeutic use of drugs in newborn
Prematurity
Not included on state list of diagnosed/established conditions.
Low Birth Weight, Very Low Birth Weight, Small for Gestational Age
List of diagnosed conditions includes extremely low birth weight.
Prenatal Exposure to Zika
Not included on state list of diagnosed/established conditions.
